Frisia – General Terms and Conditions for Contests

  1. Organiser and Scope

This contest is organised by Astra Sweets NV, Bleukenlaan 18, 2300 Turnhout, Belgium (hereinafter “Astra Sweets”), under the brand name Frisia.
These General Terms and Conditions (“GTC”) apply to all Frisia contests organised by Astra Sweets, whether independently or in collaboration with partners.
Additional or specific conditions per contest (“Specific Terms”) may be published on the contest page or via social media. In the event of discrepancies, the Specific Terms shall prevail.

  1. Eligibility

  1. Participation is free of charge. All costs (such as shipping costs for prizes) are borne by Astra Sweets.
  2. Participation is open to individuals aged 16 and over.
    Participants under the age of 18 declare that they have obtained permission from their parent(s) or legal guardian to participate in the contest. Astra Sweets reserves the right to request proof of such consent.
  3. Participation is open to individuals residing in Belgium or the Netherlands.
  4. Participation is not dependent on the purchase of any product or service.
  5. Employees of Astra Sweets or its affiliated companies, as well as their family members, are excluded from participation.
  6. Contest bots, automated entry platforms and competition groups are excluded.
  7. Astra Sweets may exclude participants in cases of fraud, abuse, breach of these terms or inappropriate behaviour. Prizes already awarded may be withdrawn. Astra Sweets’ assessment of fraud or abuse is final and binding. No correspondence will be entered into regarding such decisions.
  8. Participants must provide accurate and complete personal details.

  1. Entry Procedure

  1. Participation takes place via a fully completed online entry form (first name, last name, email address, full address and, where applicable, telephone number).
  2. Incomplete, incorrect, illegible or misleading entry forms will be considered invalid and will not qualify for participation.
  3. Only one entry per person per contest is permitted, unless stated otherwise in the Specific Terms.
  4. By participating, the participant agrees to these GTC, any applicable Specific Terms and Astra Sweets’ privacy policy.
  5. The participation period closes on the date and time stated in the contest communication (unless otherwise specified: 11:59 PM).
  6. Astra Sweets reserves the right to modify, postpone or terminate the contest at any time for organisational, technical or other legitimate reasons, without any obligation to provide compensation. Entries correctly registered prior to termination will remain valid. Astra Sweets shall not be held liable for any direct or indirect damage resulting from such modification, suspension or termination.

  1. Prizes and Selection of Winners

  1. Participants have the chance to win the prizes as described in the contest communication.
  2. Winners will be selected by random draw or by another method depending on the contest format. If winners are selected by random draw, this will be conducted by a neutral and independent party or via an objective and verifiable drawing mechanism.
  3. Winners will be notified within 14 days after the end of the participation period via email, Instagram direct message, Facebook private message or another indicated communication channel.
  4. If a winner does not respond within 7 days of notification, they automatically forfeit their right to the prize and a new winner may be selected.
  5. Prizes are non-exchangeable for cash and may not be exchanged or transferred to third parties.
  6. No second delivery attempt will be made. In the event of incorrect or incomplete address details, the prize will be forfeited. Astra Sweets is not liable for loss, delay or damage to prizes during shipment or transport by third parties.

  1. Social Media Contests

  1. Instagram, Facebook, TikTok or any other social media platforms are not responsible for this contest.
  2. This contest is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, TikTok or any other social media platform.
  3. By participating, the participant acknowledges that they fully release these platforms from any liability in relation to the contest.
  4. Participants must comply with the terms of use of the relevant social media platform.
  5. Any questions, comments or complaints regarding the contest must be directed to Astra Sweets NV via info@my-frisia.com.

  3. Astra Sweets processes only the personal data necessary for:
    1. organising the contest
    2. identifying the winner
    3. delivering the prize
  4. Personal data will not be used for marketing purposes unless the participant has given explicit and prior consent via a separate, unticked opt-in checkbox (for example: “I would like to receive promotions and news from Frisia”).
    Granting or refusing this consent has no impact on participation chances or the validity of the entry.
  5. Processed data may include:
    1. first and last name
    2. email address
    3. postal address
    4. where applicable, telephone number
  6. Legal basis for processing: performance of a contract (Article 6(1)(b) GDPR).
  7. Data will not be shared with third parties unless necessary for the execution of the contest (for example, a transport service for prize delivery).
  8. Data will be deleted after the contest has ended, unless statutory retention obligations apply.
  9. Participants have the right to access, rectify, erase, restrict processing, object to processing and request data portability.
  10. Complaints may be submitted to the Belgian Data Protection Authority or the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

  1. Liability & Miscellaneous Provisions

  1. Astra Sweets shall not be liable for technical failures, network issues, delays, incorrect data entry or other technical problems that prevent participation.
  2. Unlawful, offensive or legally prohibited submissions will be immediately removed and may result in exclusion from participation.
  3. The contest results are final and binding. No correspondence will be entered into regarding the outcome.
  4. Astra Sweets shall not be held liable in cases of force majeure, including but not limited to natural disasters, strikes, pandemics, government measures, technical failures beyond its reasonable control or other unforeseen circumstances that prevent or hinder the organisation of the contest.
  5. These terms are governed by Belgian law.
  6. Any disputes shall fall under the exclusive jurisdiction of the courts of Antwerp, division Turnhout.
